Property rights and Bill C-21

When I think about property rights in Canada today, I cannot avoid thinking about firearms and the way the federal government has chosen to regulate them through legislation like Bill C-21. For many Canadians who legally own firearms, the issue is not simply about guns themselves. It becomes a broader question about whether the government can compel citizens to surrender lawfully acquired personal property and whether the reasons for doing so have been thoroughly examined and justified.

From my perspective as a citizen and property owner, the controversy surrounding Bill C-21 reflects this deeper tension. The legislation, which received royal assent in 2023, forms part of a wider federal strategy to reduce gun violence. Among its measures are a national freeze on the purchase, sale, and transfer of handguns by private individuals, new “red flag” provisions that allow courts to order firearms removed from individuals considered a risk, and stronger penalties for gun trafficking and smuggling. These policies were presented by the government as necessary tools to improve public safety and reduce firearm-related crime.

Yet as I reflect on it, the policy goes further than simply regulating future sales. It also connects to earlier prohibitions and a federal program intended to remove certain “assault-style” firearms that were banned following the May 2020 Canadian firearms ban. The government’s plan includes compensation for owners and requires affected firearms to be surrendered, deactivated, or otherwise disposed of once the amnesty period expires. For many licensed owners, that requirement feels less like regulation and more like compelled forfeiture of property that was legally purchased under the rules that existed at the time.

This is where my own questions about justification begin to arise. The federal government argues that limiting access to certain firearms helps reduce gun violence and addresses risks associated with domestic violence, organized crime, and mass shootings. In principle, the goal of protecting public safety is one that most Canadians can agree with. Any responsible government has a duty to address violence and protect its citizens.

But at the same time, I find myself wondering whether the policy has fully confronted the realities of gun crime in Canada. Much of the violent crime involving firearms has historically been linked to illegal weapons, smuggling, or criminal networks rather than firearms owned by licensed sport shooters or hunters. Critics of the legislation argue that focusing heavily on legally registered firearms risks placing the burden on those who are already the most regulated and compliant members of the firearms community. That concern raises a legitimate policy question: are we addressing the root causes of gun violence, or are we targeting the easiest part of the problem to regulate?

Another issue that gives me pause is the broader legal and ethical framework. Canada does not explicitly enshrine property rights in the Canadian Charter of Rights and Freedoms, but our legal tradition still expects that government interference with private property be justified, proportionate, and supported by clear public benefit. When the state requires citizens to surrender property they legally acquired, even with compensation, the threshold for justification should be especially high.

So when I consider Bill C-21, I find myself balancing two ideas at once. On one hand, governments do have legitimate authority to regulate dangerous items and respond to threats to public safety. On the other hand, citizens also have a reasonable expectation that the property they lawfully own will not be taken away without compelling and well-demonstrated evidence that such action will meaningfully improve safety.

In the end, when I look at the publicly available data and the arguments that have been presented, I am left with the sense that the justification remains contested rather than conclusively proven. While the government points to the potential risks posed by certain types of firearms and the desire to prevent future tragedies, critics continue to argue that existing crime statistics show a large portion of gun violence involving illegally obtained weapons rather than those owned by licensed Canadians. Because of this gap between the stated policy goals and the evidence many people believe is most relevant, I find it difficult to conclude that the reasoning behind confiscation measures has been fully demonstrated beyond debate. Instead, the policy appears to rest on a precautionary approach to public safety—one that some Canadians view as prudent, while others see as insufficiently supported by the data used to justify taking legally owned property.

Personal Defense

I rarely if ever promote a business or online offering. In the case of the PDN (Personal Defense Network,) I am going to make an exception.

The why is simple, the reason is logical.

I am sure that many of the readers of this blog realize that I have no tolerance for people who use guns to achieve a nefarious goal. They must also realize that some of the posts in this blog, and my other blog about larger than life people of our time (http://gigantesfaculas.blogspot.com/) are about people who in one way or another do what’s right.

By posting PDN on this site I am giving kudos to people who understand that we live in uncertain times but still want people to be capable and safe in what they do. Any fool can go and buy a gun without any formal training or mindset development going along with that purchase. The results are often, unfortunate, and sometimes tragically deadly.

PDN offers numerous videos, articles, seminars and regular emailed articles on personal defense. Some of those topics include such things as:

Defense Gear, Firearms Training Videos, Home Defense, Knife Training, Product Reviews,         Personal Protection Training,  and articles on Self Defense Firearms, Defensive Issues,
Equipment and Accessories, News and Events, Non-Firearm Defensive Tools,

Yes, they have paid memberships which include member benefits such as Special Bundles & Sets, Video Downloads, Self-Defense DVDs, Personal Defense Classes and a host of other perks.

The people at PDN  seem to understand that a gun in an untrained hand is dangerous to everyone around them including the owner. They understand that being well trained in personal defense is a good thing. They also seem to understand that training develops a safe mindset regarding personal and home defense, and that’s a good thing.

I have always believed that a society that allows its citizens to own firearms also has the responsibility to ensure the proper (and legal) usage of such weapons. Scandinavian countries for example seem to generally accept and promote the safe use of firearms in a societal context while other societies such as in Japan, firearm ownership is extremely controlled v/s the U.S.A where the gun culture seems to NOT take any responsibility for the safe use and ownership of firearms. (I will take flak for that comment but perception is everything)

PDN’s articles and training offerings seem to want to develop a safe culture surrounding personal defense, not just the “wild west” approach of buy a gun and be a fool when you use it.

He was a soldier


Old Iron Jaw

He was a soldier, written about in the book "We Were Soldiers Once…And Young", and portrayed in the movie  "We were soldiers". He was awarded 28 different personal, unit, campaign and service awards and decorations (40 total) in almost 33 years of military service, spanning World War II, the Korean War, and the Vietnam War.

He parachuted into 4 major battles as a member of the 82nd Airborne Division, with which he made combat jumps at Sicily, Salerno, Normandy (D-Day) and the Netherlands (Operation Market Garden). He went on to make one more combat jump in Korea with the 187th Airborne Infantry Regiment.

He was awarded multiple decorations and wore Master Parachutist wings with a gold star signifying those five combat jumps.

He is most famous for his actions as Sergeant Major of the US Army’s 1st Battalion, 7th Cavalry Regiment, at the Battle of Ia Drang in Vietnam, 1965. Lieutenant General Hal Moore, who, as a lieutenant colonel, was his battalion commander during the Battle of Ia Drang, and praised him as an outstanding NCO and leader.

The Battle of Ia Drang was the first major battle between regulars of the United States Army and regulars of the People’s Army of Vietnam of North Vietnam during the Vietnam War. The two-part battle took place between November 14 and November 18, 1965, at two landing zones (LZs) in the Central Highlands of South Vietnam near the Ia Drang river.

The initial North Vietnamese assault against the landing 1st Battalion, 7th Cavalry at LZ X-Ray was repulsed after two days and nights of heavy fighting on November 14–16, with the Americans inflicting heavy losses on North Vietnamese regulars and Viet Cong guerrillas.

In a follow-up surprise attack on November 17, the North Vietnamese overran the marching column of the 2nd Battalion, 7th Cavalry (1st Battalion’s sister unit) near LZ Albany in the most successful ambush against U.S. forces of the war. Both sides suffered heavy casualties; the U.S. had nearly 250 soldiers killed but claimed to have counted about 1,000 North Vietnamese bodies on the battlefield and estimated that more were killed by air strikes and artillery.

After his retirement, he worked 15 more years for the army as a civilian in administration at Martin Army Community Hospital and at various medical clinics around Fort Benning (Fort Benning, Georgia), retiring again in 1990.

Sergeant Major Basil L. Plumley – Veteran of 3 Wars died, on October 10, 2012.

Career soldiers have always impressed me not because they were soldiers but because they willingly spent their entire life in harms way. Any moment could see them being shipped off to resolve the latest political blunder or "enemy" action.

As a former commercial diver I was often underwater doing what most people would normally do on land. The diving suit was simply a tool of the trade, my "taxi" to the submerged world in which I worked. For Sergeant Major Plumley, for police officers and other career soldiers, guns are simply one of the tools of their trade but in no sense of the words could career soldiers or police officers be considered as having guns for brains or guns on the brain.

Honor

Maybe it is, maybe its not. Does it really matter? This simple yet powerful image so simply illustrates the difference between good and evil. It so simply states the difference between cowardice and bravery. It so simply states the difference between everything that is wrong with this world and everything that this world should be.
 
It is not uncommon to read of, or hear about yet another cleric or religious fanatic or terrorist state  riling against the west and its' way of life. It is not uncommon for these same people to hold up western society as a reason to justify their particular brand of hatred and brutality saying they denounce western civilization as evil.
 
Perhaps it is easy to paint someone with guns who stands between you and your ideological goal as being the bad person, the evil western society that is out to get you. Unfortunately for those people, their own actions dictate otherwise.
 
When your ideology takes away peoples rights to life, their rights to their own freedom, their rights to live without fear of persecution, then your ideals are wrong. That may be a "western" value I am placing on an "eastern" fanatic, but when you rely on butchery to attain your goal, perhaps there is something fundamentally wrong with your goal.
 
My vote will always go those who shield the victims. My vote will always go to those who stand up for the weak, fight for the weak and protect them from harm.

Gertrude Bell

Although the world is tearing itself apart with people claiming to be this, that, or another thing, Gertrude Bell was the real thing. When guns were blazing all about during WWI she and her companions were knowingly, or perhaps unknowingly creating our modern stage of conflict.

Gertrude Bell, lady of the desert, a strong will that shaped the modern history of the desert people.
Intelligent, a maker of kingdoms, all without guns. Brains for guns, and still remembered by those who use guns for brains.

Gertrude Margaret Lowthian Bell, CBE was an English writer, traveler, political officer, administrator, spy and archaeologist who explored, mapped, and became highly influential to British imperial policy-making due to her knowledge and contacts, built up through extensive travels in Greater Syria, Mesopotamia, Asia Minor, and Arabia.

Along with T. E. Lawrence, Bell helped establish the Hashemite dynasties in what is today Jordan as well as in Iraq.

She played a major role in establishing and helping administer the modern state of Iraq, utilizing her unique perspective from her travels and relations with tribal leaders throughout the Middle East. During her lifetime she was highly esteemed and trusted by British officials and given an immense amount of power for a woman at the time. She has been described as "one of the few representatives of His Majesty's Government remembered by the Arabs with anything resembling affection".

It's November 13th, 2015 and we have just recently honoured the fallen warriors of our many past wars.
 
We do this so that those who were not alive then can perhaps gain a sense of the sacrifices our fathers and brothers and sisters and mothers made to ensure the safety and freedom of our children and their children's children.
 
We do not take easily the road to war. We do not easily return from war. We do however, by our actions of the past give fair warning to those who would challenge our way of life, or attempt to take our lives that we will fight and win the wars that you bring to our door step.
 
We give fair warning to terrorists, religious fanatics, the madmen and butchers that inhabit this earth, we will beat you down. You see our peaceful ways as weakness, but they are our strength. We unsheathe our sabers and our bayonets only as a last resort. We do not willingly shed the blood of our enemies but shed your blood we will when you force us to.
 
Have no doubt, your days are numbered. Have no doubt, we will prevail.

Captain Ed Freeman.

 
 

R E S P E C T

You're a 19 year old kid. You are critically wounded and dying in the jungle somewhere in the Central Highlands of Viet Nam . It's November 11, 19...67. LZ (landin...g zone) X-ray. Your unit is outnumbered 8-1 and the enemy fire is so intense from 100 yards away, that your CO (commanding officer) has ordered the MedEvac helicopters to stop coming in. You're lying there, listening to the enemy machine guns and you know you're not getting out. Your family is half way around the world, 12,000 miles away, and you'll never see them again.

As the world starts to fade in and out, you know this is the day. Then - over the machine gun noise - you faintly hear that sound of a helicopter. You look up to see a Huey coming in. But.. It doesn't seem real because no MedEvac markings are on it. Captain Ed Freeman is coming in for you. He's not MedEvac so it's not his job, but he heard the radio call and decided he's flying his Huey down into the machine gun fire anyway. Even after the MedEvacs were ordered not to come. He's coming anyway. And he drops it in and sits there in the machine gun fire, as they load 3 of you at a time on board. Then he flies you up and out through the gunfire to the doctors and nurses and safety. And, he kept coming back!! 13 more times!! Until all the wounded were out. No one knew until the mission was over that the Captain had been hit 4 times in the legs and left arm. He took 29 of you and your buddies out that day. Some would not have made it without the Captain and his Huey. Medal of Honor Recipient, Captain Ed Freeman, United States Air Force, died last Wednesday at the age of 70, in Boise, Idaho. May God Bless and Rest His Soul.

I bet you didn't hear about this hero's passing, We’ve heard plenty about murders, Health Care, Border security etc. BUT NOTHING ABOUT THE PASSING OF Medal of Honor Winner Captain Ed Freeman. Shame on the media !!!

U.S. Election


Why this post ?

It would seem that this man is eminently qualified to speak on the future of these United States of America. It would seem that as guns become more and more prevalent in America the clear voices of reason and intelligence seem to be getting lost in the noise of lobbyists, big business and outright ignorance.

This election, like any other, will see it's share of big money backing supposedly big men (and women) who will move forward this agenda or that agenda. It will see rhetoric and mud slinging and all the usual attack ads and bad ideas.

Like all other elections, this go around will not see any significant change, just more of the same but with a new flavor of the month coating. This is BAD.

A continuation of the way things are will see America slide further and further away from the ideals upon which she was founded. We will slip deeper into debt, global disrespect, more wars, less pride in our accomplishments and worse yet, we will dig more graves.

This go around, tell the lobbyists, big business and those seeking personal glorification to go home. Tell the NRA that we have buried enough children. Tell big business that we have paid enough already. Tell the government that we have fought enough wars.

It's time to tell our children that this time, we the citizens of America will win the election.

When a contractor "joins" the military by receiving military contracts, there is only one reason. Profit.

Well Said


Another quote from somewhere is:

"if you are unwilling to stand behind your troops, you are welcome to stand in front of them."

The image and the quote both say the same thing. It is unfortunate that we are willing to slam the fist of our military into the belly of someone else but are unwilling to take responsibility for having done so. By sending our troops out to be in harms way we are obligated to defend them to the best of our ability with modern weapons, strong political will, and most importantly, support from our citizens.

We hope that when we send our troops out that the reason is just, is not politically of financially motivated, or otherwise the wrong decision. The unfortunate truth is that we often send our troops out for the wrong reason. Then and only then should we rebel against the troop deployment as they also are good citizens who joined up to fight for what is right.

But never should we rebel against the troops.

A sad state of affairs

Since then 1990s, successive Canadian governments, both Conservative and Liberal, have shunned traditional UN-mandated peacekeeping for U.S.-led war-fighting missions in Kosovo, Afghanistan and Libya. Those campaigns have eclipsed the UN as Ottawa’s favoured military expeditionary effort. From being the top contributor in the early 1990s, the Canadian commitment dropped precipitously from thousands, to hundreds a decade ago to only a few dozen in recent years."

It is a really sad day in Canada when an article such as the quote from the one above can be published with truth. Canada, a once proud nation of international peace keeping repute has picked up the gun for aggressive rather than protective purposes. This is Prime Minister Harper's Canadian legacy to the world and to the children of Canada.

Some may be able to justify the Canadian military actions in Afghanistan, Libya and other hot spots around the globe, but without peace keeping actions, Canada has become just another aggressor.

The balance between making peace and keeping peace must be maintained otherwise the imbalance simply leads to more conflict and more loss of life, mostly civilian.

Consider the aggressor:
Fight for personal gain; Fight for power and reputation; Fight for no good purpose.

Consider the Peace Keeper:
Fight to protect; Fight to maintain life: Fight for a future without fighting.

Consider Canada:
International Peace Keeping reputation now shredded by the current self serving Prime Minister contrasted to the strong willed and brave peace keepers such as General and Senator Roméo Dallaire

Now consider this:
ISIS and other terror groups running amok as the international community is to self serving and weak to mount a suitable offensive. Hiding behind international laws which no terrorist will ever abide by.

This blog is about guns for brains but it would seem that those who have brains are afraid to use the guns to defeat those who have guns but no brains.

In light of the atrocities being committed world wide it is easy to see why the Canadian prime Minister would unleash the Canadian Military in aggressor actions. It is unconscionable that the balance between fight and defend is so out of balance. Until such time as the worlds nations decide that oil is not the only reason to go to war, the western forces will be seen as aggressors, not Peace Keepers or peace makers.
